ARBITRATION AGREEMENT

This Arbitration Agreement ("Agreement") is entered into by and between ACG Dumpster Rentals LLC DBA ACG Rental Trailer, located at 243 Waters Edge Drive, Erwin, North Carolina 28339, and the person identified as the renter or additional renter on the Rental Contract Terms, Conditions, and Agreements(collectively, the "Parties").

1. Scope of Arbitration

The Parties agree that any dispute, claim, or controversy arising out of or relating to this Agreement, including its formation, interpretation, performance, or breach, shall be resolved exclusively through final and binding arbitration, rather than through a court of law.

2. Governing Rules

The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), as modified by this Agreement.

3. Arbitration Process

  • a. Notice of Arbitration: A party seeking arbitration must provide written notice to the other party outlining the nature of the dispute, claim, or controversy and its intention to initiate arbitration.
  • b. Selection of Arbitrator: The arbitration shall be presided over by a single arbitrator agreed upon by the Parties. If the Parties cannot agree, the arbitrator shall be appointed in accordance with the rules of the Arbitration Institution.
  • c. Location: The arbitration shall take place in Charlotte, North Carolina, or as otherwise agreed by the Parties.
  • d. Language: The proceedings shall be conducted in the English language.

4. Arbitration Costs

The costs of arbitration, including filing fees and the arbitrator’s fees, shall be paid by the person identified as the renter or additional renter on the Rental Contract Terms, Conditions, and Agreements, unless otherwise determined by the arbitrator. 
The person identified as the renter or additional renter on the Rental Contract Terms, Conditions, and Agreements, shall pay for ACG Rental Trailer's legal fees and expenses.

5. Final and Binding Decision

The arbitrator’s decision shall be final and binding on the Parties and may be entered and enforced in any court of competent jurisdiction.

6. Waiver of Class Actions

The Parties agree to resolve any disputes on an individual basis and waive the right to participate in any class or collective action.

7. Confidentiality

All aspects of the arbitration proceedings, including any documents, evidence, and awards, shall remain strictly confidential, except as required by law.

8. Miscellaneous

  • a. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • b. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of laws principles.

Acknowledgment and Agreement
By signing below, the Parties acknowledge that they have read and understood this Arbitration Agreement and voluntarily agree to its terms.
